A settlement of $1.3 million has been released to resolve a class action lawsuit. According to the Food Class Action Settlement, the lawsuit filed against the Metagenics food products alleges that the products are falsely advertised as being able to treat various medical conditions. The medical conditions include diabetes, cardiovascular problems, fatigue, and bowel problems.
Metagenics is a global nutria-genomics and lifestyle medicine company and sells 17 different types of “Medical Foods”.
If you purchased a Metagenics product labeled as “Medical Food” since Nov. 9, 2011, then you could get compensation from this lawsuit settlement.
The plaintiff William Grivas claims that he and other consumers purchased the food products sold by Metagenics in the thought of health benefits. The label of “Medical Foods” was mention on their product. The plaintiff accuses that these products may cause health issues like “metabolic syndrome,” “compromised gut function,” and others.
According to the class action lawsuit, the advertisement violated California consumer protection laws.
The result of the Class-Action Lawsuit Settlement:
- The Class Members can file a claim for up to five products they purchased from Metagenics without proof.
- And, the Class Members who have proof of their purchase, including receipts, can submit claims for more than five products.
- The settlement administrator will divide the award price according to the number of valid claimants.
Note: Class Members with an objection to settlement can report before March 17, 2019.
Eligibility For Claim:
The Class Members who live in the U.S and purchased Metagenics products since Nov. 9, 2011.
Proof Required For Claim:
Class Members can file a claim for up to five products without proof. But, if want compensation for more than five products then, you need to provide proof in terms of receipt.
Potential Award
The potential award is yet to be determined, and each class member’s award will depend on the number of products purchased and the valid claims that are submitted.
