Case Summary of Subway Credit Card Lawsuit
In this receipt settlement, the lead plaintiffs alleged that the company had violated FACTA (Fair and Accurate Credit Transactions Act). Under this act, the merchants who accept credit and debit cards should limit the information that is provided on receipts. According to the law, an enterprise cannot print the expiry date or more than the last five digits of the card on receipt.
However, Subway went against the act by printing an expiry date on the customer’s Subway credit card and debit receipts.
The Subway credit card settlement has alleged that the expiration dates were on receipts at certain locations of the restaurant. According to the settlement, the locations that have the company’s Payment Manager System were affected. However, under the terms, the restaurant along with its associated company will pay $30.9 million to the class members.
The Class Members include the customers who have used the card as the mode of payment to pay at Subway, between Jan 1, 2016, and March 23, 2017. But Subway credit card class members only have until Jan’22, 2019 to submit a claim or exclude themselves from the settlement.
The final hearing is on March 8, 2019.
