According to the Gateway Energy settlement, they have agreed to pay $9.25 million to resolve the class action lawsuit against it which was filed for violation their energy contracts.
Individuals who were enrolled in a Gateway residential variable rate plan in New York, New Jersey, Pennsylvania, Maryland, Virginia, Kentucky, and Ohio can get compensation. The exact date of enrollment for each state is available in the “Eligible” section below.
Case Summary
Three separate class actions will get resolve with gateway energy settlement. The plaintiffs who filed case in the court, argued that the Gateway energy services violated its own contract of terms and laws as it adjust consumer energy rates on other factors rather than market prices.
According to the claimants the company allegedly pledged its contract terms and conditions. However, the company took advantage of consumers by luring them in low rates policy and raise monthly rates later on.
“Defendant’s representations are deceptive,” the Gateway class action lawsuits claimed. Further the lawsuit claimed that “In fact, Defendant’s variable rates are higher than others available in the natural gas market.”
The settlement will benefits consumers with $.00333 per kilowatt hour of electric supply service and $.02509 per therm of natural gas supply through Gateway.
Class Members can file a valid Claim Form before Aug. 1, 2019 to get the benefit from the settlement. The deadline for exclusion and objection is also Aug. 1, 2019.
Who are Eligible to File the Claim?
Individuals who enrolled in a Gateway rate plan and paid Gateway variable rates for electricity in the following states:
- New York (from November 2012 to April 5, 2019)
- New Jersey (from November 2012 to April 5, 2019)
- Pennsylvania (from November 2012 to April 5, 2019)
- Maryland (from November 2015 to April 5, 2019).
Additionally, the Class includes consumers who paid for natural gas in the following states:
- New York (from July 2011 to April 5, 2019)
- New Jersey (from July 2011 to April 5, 2019)
- Pennsylvania (from November 2012 to April 5, 2019)
- Maryland (from November 2015 to April 5, 2019)
- Virginia (from November 2013 to April 5, 2019)
- Kentucky (from July 2011 to April 5, 2019)
- Ohio (from July 2011 to April 5, 2019).
