Commercial Truck Parking Heater Indirect Purchaser Settlement

A commercial truck parking heater purchaser settlement, worth $7.7 billion has reached antitrust litigation against Webasto and Espar. The lawsuit involved in this multidistrict litigation had made an allegation that Webasto and Espar came up together to bring the prices of new parking heaters, which resulted in consumers being overcharged when they purchased parking heaters and the commercial vehicles with parking heaters.

As a part of the Purchase Settlement, Espar has contributed $3.8 million, and Webasto contributed $3.9 million, which amounts to be $7.7 million. Moreover, this settlement resolves all the claims against the companies, without accepting any wrongdoing.

However, there is no fixed estimate on how much amount each Class Member will receive. The Class Member has until Feb’1, 2019 to submit a claim through the settlement website. It includes all the customers who have purchased the heater or a vehicle with Webasto or Espar, between Oct 1, 2007, and Dec 31, 2012. But the direct purchasers are not included in this settlement.

Furthermore, the class counsel can ask for up to 1/3rd fund of the settlement fund for attorney fee along with the extra expenses and costs, including incentive payments for Class Representatives.

If Class Member wishes to exclude them from the commercial truck parking heater indirect purchaser settlement, you have to do it by Dec’1, 2018. The members who have failed to exclude themselves or do not file a claim will not receive any potential award.

The consumers who have indirectly purchased Webasto/ Espar heaters between Oct 1, 2007, and Dec 31, 2012 and direct purchasers are not included in the settlement.
