Metals USA company has agreed to pay $2.8 million to settle the claim against it. The class action stated that Dura-Loc roofing panels failed before the 25-year anticipated lifespan warranty.
The class action settlement offers benefit to those who owned a home or other structure in California with continental, shadow line, or wood shake panels. The panels were manufactured by Dura-Loc and installed in class members home between July 1, 1996 and May 12, 2006.
The plaintiffs James Wilson and Jack White filed lawsuit against Metals USA Inc. in March 2012. They purchased Dura-Loc roofing tiles for their homes in 2004 which get failed before lifespan.
The men claiming that when they purchased the tiles they relied on representations about UV resistant tiles that would last for at least 25-years. Despite these representations, the tiles deteriorated due to a defect known as “degranulation.”
The lawsuit reportedly causes the bonding on the tiles degrade when exposed to UV rays, which further detached the stone portion of the tile.
Further, Wilson and White argued that this defect contradicts the claims made by Metals USA. But, the company not admit any wrongdoing b. Instead, ready to settle the case to avoid the risks and costs of trial.
The Class Members can receive $10 for each defective panel, maximum up to 300 panels, if they file a claim before June 14, 2019. Proof is required along with a valid claim.
