In June 2021, Phillips announced a recall of millions of Phillips CPAP, BiPAP and Ventilator machines due to serious respiratory problems including potential cancer risk. Thousands of affected individuals are filing a Philips CPAP Machine Recall Lawsuit.

According to the FDA’s investigation, Phillips’ own internal testing showed the degradation of PE-PUR foam as toxic and potentially carcinogenic. Phillips chose to keep using the PE-PUR foam anyway and did not alert anyone of the risk of using their products.

Phillips manufactured defective devices but failed to warn the public of the risk and serious injuries their machines were causing.

If you or your child used one of these recalled Phillips CPAP machines and were later diagnosed with cancer or lung injury, you may have a legal claim.

What Happened With Phillips CPAP Sleep Apnea Machines?

Philips recalled millions of CPAP, BiPAP & Ventilator machines because the polyester-based polyurethane (PE-PUR) sound abatement foam used in the tubes could disintegrate (fall apart) causing toxic foam to be breathed into during sleep. Breathing in these dangerous substances is terrible for health. Many users complained of headaches or bronchial infections that have resulted from chronic inflammation or infection of the upper airways and CPAP foam was attributed as the reason for the problem.

Why should I file a CPAP lawsuit?

If you or a relative was injured by a recalled Phillips CPAP machine you have a right to file a claim. Lawyers are offering free consultation and will file your claim free of charge to you. Time is limited to file your claim, so speak with a lawyer as soon as possible.

According to Philips, this possible health risk can result in many different patient effects, ranging from traumatic and transient traumatic injuries to serious traumatic events. The risk is life-threatening or can permanently damage the person. A faulty ventilator or bi-patient can cause permanent harm to a person’s life.

What is an average settlement payout for a CPAP lawsuit?

The CPAP sleep apnea recall litigation is in the early stages.

It is difficult to predict the average settlement payout amounts. But, there are similar claims that have been settled for products that have caused cancer. Generally speaking, a successful jury trial can be millions to thousands of dollars. However, settlements are generally lower.

In successful cases, victims can expect a settlement between $50,000 and $300,000. However, it is predicted that Philips CPAP recall lawsuits will have a higher average settlement value.

How Serious Is the CPAP Recall?

CDC classifies Philips’ CPAP as class 1 — the most severe — because its use may cause serious injury (including cancer) to people. Devices aimed at improving breathing contaminate our airways. Philips’recalled BiPAP machines and mechanical ventilators feature sound abatement foam liners manufactured that can disintegrate and become part of the air and the filter will not prevent it. These small particles may penetrate through the lung alveoli into the bloodstream.

Backstory Behind the Philips CPAP Recall

Sleep apnea is a very common medical problem affecting 24 million Americans. Sleep apnea causes breathing difficulty and disrupts breathing while sleeping. Oftentimes, this disruption in oxygen flow can result in various medical conditions including stroke and heart attack. CPAP therapy has become the predominant therapy for insomnia. This technique involves putting in place an airway through a mask to provide airflow to the patient.

However, approximately 350,000 Phillips CPAP machines were defective.

What should I do if my CPAP machine is recalled?

Anyone who has a Phillips CPAP, BiPAP or Ventilator that has been recalled may contact Philips Respironics at 1-800-276-7880. Philips can send you replacement devices when available with instructions on how to return the defective device.

Is there an alternative to the Phillips CPAP machine?

Over 24 million Americans have sleep apnea and many can’t stop using a CPAP machine even though it has been recalled.

Phillips 2nd generation DreamStation2 is not part of the Phillips CPAP recall.

Here are some alternatives to using a Phillips machine:

  • ResMed AirSense 10 CPAP
  • Z2 Auto Travel CPAP Machine
  • Philips Respironics DreamStation 2 Auto
  • DeVilbiss IntelliPAP 2 Auto Adjust CPAP
  • F&P SleepStyle Auto CPAP

When choosing a new CPAP machine, make sure to consult your doctor or insurance company for recommendations.

What is the difference between CPAP & BiPAP machines?

BiPAP machines are a popular alternative to a CPAP device for sleep apnea. Similar to a CPAP machine, a bilevel positive airway pressure machine (BiPAP) aids people with sleep apnea and other breathing problems.

Unlike BiPAP devices which uses higher pressure when a person breathes in and less pressure when they breathe out; CPAP devices use the same amount of pressure when one breathes in or out.

However, a BiPAP device may not be a good option for those with poor breathing, reduced consciousness or problems swallowing.
