The Smith medical unwanted fax ads class-action lawsuit was filed in 2018. And, the settlement has reached under this lawsuit. The company use fax numbers to send ads to the customers’ without their permission.<\/p>\n
Did you receive any unwanted fax ads from or on behalf of H. D. Smith LLC or Smith Medical Partners between Sept. 26, 2013, and Jan. 25, 2019? If yes, then you could get nearly $500 from the class action settlement.<\/p>\n
The lawsuit alleged that H. D. Smith, LLC and Smith Medical Partners sent many faxes to the class members without permission. According to the lawsuit it is the violation of the Telephone Consumer Protection Act.<\/p>\n
However, a $21 million settlement has been reached to resolve the allegations against Smith Medical Partners. The plaintiff, Florida doctor alleged that he and others received unsolicited advertisements by fax from pharmaceutical distributors.<\/p>\n
They further alleged that these \u201cjunk faxes\u201d wasted recipients\u2019 paper, ink, and monopolized the use of their fax machines. The Smith Medical lawsuit also alleged that the unwanted faxes violated the Florida consumer protection laws as well as the Telephone Consumer Protection Act.<\/p>\n
The law is meant to protect consumers from unsolicited marketing techniques from various companies. The Act also protects consumers from telemarketing calls. So, according to the TCPA rules, companies who send unwanted fax without prior permission are subject to steep fines of up to $500 per communication. Approximately 45,000 fax numbers were used by the Smith Medical to send unauthorized ads.<\/p>\n
To make or file a valid claim, Class Members have to fill the complete Claim Form, including a Claim ID number and PIN Code mention in the notice.<\/p>\n
But, all those Class Members who wish to object to or exclude from the class action settlement must do so by March 25, 2019.<\/p>\n
All the Class Members who received ad faxes, by or on behalf of H. D. Smith, LLC or Smith Medical Partners, LLC between September 26, 2013, and January 25, 2019.\u201d<\/p>\n
