The Allstate car insurance policyholders in Montana are eligible for compensation under $2.6 million class action settlement. There are several Allstate entities that have agreed to settle a class action lawsuit against them.<\/p>\n

This lawsuit has made an allegation that the insurance company recovered the subrogation (it is the legal right held by the insurance companies to pursue a third party that caused an insurance loss) wrongly from the policyholders; even when they had no legal rights to do so. But the plaintiffs in All-State car insurance class action settlement said that Montana Allstate did not have any right to subrogate.<\/p>\n

Moreover, they have also failed to do an investigation to determine, whether the policyholder’s losses should be recouped or not. But Allstate admits no wrongdoing and has agreed to pay $2, 673,500 to a settlement fund. According to the settlement, the eligible class members can file a claim and recover 30% of the amount that subrogated to an individual\u2019s claim.<\/p>\n

Moreover, the class counsel will also receive $668,375 of funds as compensation for the attorney fee. However, the deduction for litigation, class representative, and class administration costs will be deduced from the settlement amount.<\/p>\n
