\nConsumers filed a lawsuit against the company in the U.S. District Court for the Western District of North Carolina. Lead plaintiffs alleged in their lawsuit that the defendants removed LTE Band 12 functionality by releasing a software update on their Idol 3 smartphone.
\nThe Alcatel Company advertised and promoted their smartphone with full Band 12 functionality. It is an important feature sought-after by many consumers because this feature offers service coverage when none would otherwise be available. T-mobile consumers were mainly affected by the defect because the company had advertised the product along with describing the advantages of Band 12, such as expanded and improved coverage.<\/p>\n

Eligibility to File the Claim<\/strong><\/h2>\n

If you live in North Carolina or Kentucky and purchased either an Alcatel OneTouch Idol 3 4.7 inches or 5.5-inch Smartphone after January 1, 2015, and before December 27, 2016, and also used the T-mobile network, you are eligible for the claim. The T-Mobile network may include but is not limited to the other virtual network operators, such as Net10, Simple Mobile, Ting, Ultra Mobile, US Mobile, MetroPCS, Lyca Mobile, ZIP SIM, Walmart Family Mobile, etc.<\/p>\n

Eligible class members will enjoy the replacement of Alcatel smartphone. It costs $179.99. They can also get a reinstatement of the advertised LTE Band 12 functionality on their Idol 3 smartphone with a specific and a short period of time.<\/p>\n

Proof of Purchase<\/strong><\/h2>\n

Participants have to provide evidence that they purchased an Alcatel OneTouch Idol 3 4.7 inches or 5.5 inch smartphone. The purchase date should be between January 1, 2015, and before December 27, 2016. They also need to prove that they used T-Mobile Network and they are residents of Kentucky or North Carolina. They need to submit the evidence along with the Claim Form.
