InSinkErator F-201 Instant Hot Water Filter Class Action Settlement

Do you have a leaky InSinkErator F-201 water filter? If yes, then you can claim for replacement of the filter or compensation under the water filter class action settlement. The InSinkErator along with Emerson has released an amount of $3.8 million as a settlement to end the class action lawsuit against it. The class-action lawsuit against InSinkErator was initiated in December 2015 by Rockwood Retirement Communities. But, they made a settlement with the company and then the Desio and Gouveia continued with litigation of the case.

The complaint filed by plaintiffs

In hot water filter class action lawsuit, plaintiffs Richard Desio and Christopher Gouveia claimed that there was a defect in the dispensing system of water filters of InSinkErator F-201. This dispensing system was made by the defendant Emerson Electric Company. Further, the plaintiffs claimed that the defect in the filter was so severe and enough to flood the building. They also complained about the risk of property damage due to leak hot water filter.

However, the Emerson Company continued to deny the plaintiff’s claim. But it agreed to InSinkErator class action settlement to avoid the expenses and risks that come with continued litigation.

Settlement summary

According to the terms of the InSinkErator class action settlement, Emerson will release a settlement fund worth $3.8 million. And, this fund will be used by the company to cover the cost of partial refunds, replacement filters, and reimbursement for out-of-pocket repair costs related to the alleged InSinkErator defected hot water filters.

Eligibility for Claim

All the persons who owned or lease a residence or other structure as of Jan. 22, 2018 in the U.S with installed InSinkErator-201 dispenser are eligible. The old filter had manufactured between 2001 and Jan. 31, 2011.

However, the following people cannot claim for compensation under the settlement

  • Persons who experienced property damage due to the failure of an old Filter.
  • Persons who initiated legal proceedings (other than this class action lawsuit) before Jan. 22, 2018
  • Presiding judges and their immediate families.
  • Persons who intentionally opt out of the settlement

Potential award

  • The class members get replacement benefits and property-damage benefits. They may receive only one type of benefit, not the both.
  • Those who seek for replacement benefits can choose to receive up to three filters replacement or can receive cash of $15 per filter and maximum up to $45.
  • Those who want a claim for property-damage can receive cash payment according to the expenses related to their property damage.

Payments may be adjusted up or down in order to use all the allocated settlement money.

Note: Last date to fill the claim form is 12/31/2020.

In addition to the claim form, Class Members seeking “Property-Damage Benefits” need to submit proof of the property damage. They also have to submit proof of out-of-pocket repair expenses related to that property damage.
