Ocwen Mortgage Home Warranty Class Action Settlement

Ocwen Loan Servicing and Cross Country Home Services ready to settle the class action against them and have agreed to pay more than $26 million.

Both the companies allegedly sent  checks to Ocwen, GMAC, and Homeward Residential mortgage customers. Moreover, when the customers went to bank for cashed the checks, they were automatically enrolled into a home warranty without any knowledge.

The Ocwen, GMAC, and Homeward Residential customers who were enrolled in a Cross Country warranty/home service plan between Aug. 6, 2009 and Dec. 31, 2013 could get compensation.

Case Summary

The plaintiffs filed class action lawsuit against Ocwen and Cross Country in August 2013. They argued that the companies intentionally deceived customers with check scheme. Further, they claimed that the companies owed customers refund for the premiums.

However after years of filed case, a $26,457,227 settlement was reached to between companies and plaintiffs. They ready to settle the case to save themselves from risky and costly litigation.

The settlement offer a refund up to 77 percent of the total amount paid by customers for a home warranty or service plan from Cross Country. But, the exact amount of claim will vary according to the premium amount of customers and the number of payments made for the service.

The Class Members who want to recover payment from the settlement, need to submit a valid claim form before June 18, 2019. The deadline for exclusion and objection is June 18, 2019.

Who Are Eligible To File The Claim?

  • Ocwen, GMAC, and Homeward Residential customers who were enrolled in a home service plan between Aug. 6, 2009 and Dec. 31, 2013.
  • Those who made one or more payments on the plan
  • Customers who never made a claim under the plan and never received a refund.

Potential Award

77 percent refund of the total amount paid class member for the home warranty or service plan.
